Terms and Conditions of Participation in “FEIN Champions for Champions” Competition
Competition / Organiser
These terms and conditions of participation and the data protection notices regulate participation in the competition organised by FEIN Industrial Power Tools UK Ltd.

United Kingdom (hereinafter referred to as the “organiser”) by participants and the collection and use of data collected from or provided by participants. By participating in the competition, the participants accept these terms and conditions of participation.
Requirements for participation and procedure
The competition begins on 24.05.2018 (10 a.m.) and ends on 23.07.2018 (12 p.m.)
Anyone of full legal capacity, aged 18 or over and resident in United Kingdom is entitled to participate. People resident in other countries may not take part. Only people with Facebook, Instagram or Twitter accounts in their own name may participate. Participation with a forged identity or the identity of another person is not permitted.
The product shown will be awarded to one winner chosen from all participants who satisfy the above criteria and who write a comment below the FEIN Champions for Champions” Competition which satisfies the conditions specified above the post. If there is more than one correct response, an internal jury at FEIN will choose the winner. The winner will be announced immediately after the stated end of the competition and no later than one week after the end of the competition in the form of a comment below the comment posted by the chosen winner, for which the winner will be linked with his/her Facebook name. The FEIN jury will use its own discretion to select the winner.
Participants who violate the terms and conditions of participation or manipulate the competition may be immediately excluded from taking part in the competition. Participants also undertake not to publish any illegal, discriminatory or racist content. Should any such content be posted, the organiser shall be entitled at its own discretion to delete such comments. If this is the case, prizes may be disallowed later on or prizes already paid out/delivered may be claimed back.
The organiser and/or the agents appointed to run the competition are entitled to discontinue, abort or suspend the competition if
- Facebook’s/others promotion guidelines are changed during the competition such that the competition cannot take place in accordance with Facebook’s/others currently valid rules or the competition is stopped by Facebook/others for any reason;
- an attempt at misuse through manipulation is established;
- the competition can no longer be run properly, in particular should hardware or software fail, in the event of program errors, computer viruses, unauthorised intervention by third parties or mechanical, technical or legal issues.
After the winner has been identified by means of the comment, he/she will be requested to write a message on the FEIN Facebook page. The next steps will then be agreed on an individual basis and the winner will be asked to provide the FEIN social media team with his/her contact details, including e-mail address and postal address. The winner will be notified of his/her win by e-mail (using the e-mail address provided) or by post and asked to confirm that he/she wishes to receive the prize. Should a participant fail to do so within four weeks, the prize will be re-allocated. If the contact details provided are incorrect (e.g. invalid e-mail address) the organiser is not required to find the correct address. Any loss resulting from providing incorrect contact details will be borne by the participant. If all the details are correct, the prize will be sent to the winner – individual arrangements will also be made between the organiser and the winner regarding the date. The winner must accept any delays in delivery. No additional costs will be incurred for the winner – the costs of delivery etc. will be borne by the organiser.
The prize cannot be paid in cash or assets. There is no substitute for the prize and it cannot be transferred to other people. A participant may elect not to receive his or her prize, in which case another winner will be selected. (Second person who shared the correct link to the product.) Participants will be contacted individually to make arrangements for handing over the tools. Employees of FEIN Industrial Power Tools UK Ltd., sales partners and associated companies and their family members are not eligible to participate in the competition.
Exclusion of guarantee
Please note that the availability and function of the competition cannot be guaranteed. The competition may be discontinued or cancelled due to external circumstances or necessities. Participants cannot then make any claims against the organiser.
This may include technical problems, rule changes or decisions by platforms such as Facebook if the competition is organised on such platforms or jointly with them.
The following exclusions and limitations apply to the organiser’s liability for compensation regardless of other statutory qualifying conditions according to this Paragraph 6.
The organiser is fully liable for any damage caused by wilful intent or gross negligence.
The organiser is also liable for negligent breach of essential duties if this breach jeopardises attainment of the purpose of the contract and for breach of duties which are required to correctly run the competition and in the fulfillment of which the contractual partners put their trust as a matter of course. In this case, the organiser is however only liable for foreseeable damage typical for a contract of this nature. The organiser is not liable for negligent breach of duties other than those stated in the above clauses.
The above liability limitations do not apply to loss of life, physical injury and damage to health, to a defect after offer of guarantees for the condition of a product or to fraudulent concealment of deficiencies. Liability in accordance with the German Product Liability Act (ProdHaftG) is not affected.
If the organiser’s liability is excluded or limited, this will also apply to the personal liability of the organiser’s employees, representatives and fiduciary agents.
Data protection notices
The organiser only collects, stores and uses participants’ data as permitted or mandated by law or as agreed to by the participants.
The following details are collected from the participants by the organiser as permitted by law and are used to design, run and process the competition: name and address of the participant and his or her e-mail address. This data is stored for the archiving periods prescribed by law. The aforementioned data may only be used for electronic advertising purposes with the specific consent of the participant. This consent is provided using a double opt-in process, i.e. an e-mail (known as a checkmail) is sent to the e-mail address provided by the participant, asking the participant to again confirm his or her consent to receiving electronic advertising. Only once this has been confirmed will the e-mail address be activated for electronic advertising. The consent can be withdrawn at any time with immediate effect without the need for a specific form.
Data is not shared with third parties.

Alongside these terms and conditions, the relationship between the organiser, the participant and Facebook is determined by the terms and conditions at https://www.facebook.com/terms.php and Facebook’s data protection rules: https://www.facebook.com/privacy.
The participants cannot assert any claims against Facebook which come about in relation to using the competition application or participation in the competition.
The participants recognise that both the competition application and the competition are not sponsored, supported or organised in any way by Facebook and are not linked to Facebook.
All information and data shared by participants or collected from them through use of the competition application or during the competition are only made available to the organiser and not Facebook.
